THE RIGHT TO INFORMATION AND THE RIGHT OF INTELLECTUAL PROPERTY: SOME ASPECTS OF CORRELATION IN THE CONDITIONS OF INFORMATION SOCIETY
Abstract
The article deals with the theoretical aspects of the correlation between information and objects of intellectual property law; the definition of information as an object of civil rights; consideration of the methodology of civil regulation of relations in the information sphere. This article from the perspective of legal doctrine examines the features of the information, the concept of civil legal regulation of information relations at the present stage of development of legislation of Ukraine, trends and prospects of legal regulation in the information society. The information is related to intellectual activity and may have any form of external display that is suitable for perception by a person directly or through technical means. As a result of intellectual activity information can exist as an independent object, and in the form of the results of creativity, which are protected by the system of intellectual property rights. The concept of information as a result of intellectual activity can be extrapolated to informational relations of private law, the system of regulation of which is only formed in domestic legislation. In modern conditions of the formation and development of the information society, we observe a contradiction between the intellectual property rights system and the person's information capabilities as the rights of free collection, storage, dissemination and use of information. In the conditions of the information society, the development of scientific and technological activities, the monopoly right of a subject of intellectual property requires significant restrictions both in time and in spatial dimensions.
