ЕЛЕКТРОННИЙ ВИСНОВОК ЕКСПЕРТА: ТЕОРЕТИЧНІ ОСНОВИ ТА ПРАКТИЧНИЙ АСПЕКТ

Вступ. Cтаття присвячена дослідженню нормативних основ і практичного аспекту використання електронної форми висновку експерта в цивільному судочинстві. Передумовою написання статті стало ухвалення законодавцем України багатьох важливих нормативно-правових актів, що регулюють використання цифрових технологій під час здійснення експертизи в цивільному судочинстві. Метою статті є дослідження розвитку нормативного регулювання Європейським Союзом та Україною використання цифрових технологій у здійсненні правосуддя. Автор ставить за ціль проаналізувати їхні поступові кроки від загальної концепції електронного судочинства до появи нового елементу його реалізації – електронної форми висновку експерта.
Методи. Під час написання роботи автором використано такі загально- та спеціальнонаукові методи дослідження: історичний, аналіз статистичних даних, аналіз документів, порівняльно-правовий, дедукція, узагальнення, порівняння.
Результати. Автор розпочинає наукову роботу з вивчення досвіду впровадження електронного судочинства Європейським Союзом; аналізує основні документи інституцій Союзу, в яких вони викладають плани розвитку тих чи інших напрямків у цій сфері. Дослідник з'ясовує, що у своїх задумах вони не залишили поза увагою експертизу. Далі автор звертається до українського досвіду цифровізації судочинства. На нашу думку, головною проблемою у цій частині залишається недостатнє фінансування організаційного забезпечення судів України. Автор досліджує новелу українського законодавства – електронний висновок експерта. Дослідник також описує технічну точку зору створення електронного висновку експерта та його підписання електронним підписом.
Висновки. З початку ХХ ст. і донині Європейським Союзом прийнято ряд важливих документів, основна мета яких – упровадження та регулювання електронного правосуддя. У них прослідковується поступовий рух від загальних концепцій до планів у конкретних напрямках. Україна як частина європейської спільноти не залишилась осторонь ідеї цифровізації правосуддя. Основних здобутків у цьому було досягнуто після набрання чинності новими редакціями процесуальних кодексів у 2017 р. Ними закріплено використання у судочинстві підсистем (модулів) Єдиної судової інформаційно-телекомунікаційної системи (ЄСІТС). Основною проблемою, що стоїть на заваді подальшому розвитку електронного правосуддя, є недостатнє фінансування організаційного забезпечення судів. Прогресивною новелою теперішнього законодавства є електронний висновок експерта. Проте нормативне регулювання такої форми висновку не є досконалим.
