ЄВРОПЕЙСЬКІ КЛАУЗУЛИ ТА ВИБОРЧІ ПРАВА ГРОМАДЯН ЄВРОПЕЙСЬКОГО СОЮЗУ: МОДЕЛІ МІНІМАЛІСТИЧНОГО КОНСТИТУЦІЙНОГО РЕГУЛЮВАННЯ

Вступ. У зв'язку з набуттям Україною статусу кандидата на членство в Європейському Союзі актуалізується необхідність гармонізації національного конституційного законодавства з правом Європейського Союзу щодо забезпечення виборчих прав громадян Союзу. Дослідження мінімалістичної моделі конституційних перетворень держав-членів Європейського Союзу дасть можливість виробити оптимальний шлях такої адаптації без тотального перегляду Основного Закону України.
Методи. Дослідження ґрунтується на застосуванні порівняльно-правового методу для аналізу конституційних актів 17 держав-членів Європейського Союзу, формально-догматичного методу для тлумачення норм Конституції України з метою виявлення перешкод для євроінтеграції та методу аналізу і синтезу для узагальнення наукових позицій вітчизняних конституціоналістів.
Результати. Установлено, що 17 із 27 держав-членів Європейського Союзу обрали мінімалістичну модель закріплення європейських клаузул, яка обмежується лаконічними нормами-принципами. Проаналізовано конституційну практику окремих країн, які для надання громадянам Європейського Союзу виборчих прав або не змінювали конституцію взагалі, або прийняли окремі конституційні акти, або внесли лише точкові зміни.
Висновки. Визначено, що найбільш оптимальним орієнтиром для адаптації тексту Конституції України є застосування мінімалістичної моделі європейських клаузул. Вона дозволить гармонізувати законодавство та забезпечити реалізацію виборчих прав громадян Європейського Союзу без необхідності розгорнутої кодифікації євроінтеграційних норм у тілі Основного Закону.
