ОСОБЛИВОСТІ ДОКАЗУВАННЯ У СПРАВАХ ПРО ВІДШКОДУВАННЯ ШКОДИ, ЗАВДАНОЇ ЗБРОЙНОЮ АГРЕСІЄЮ

Вступ. Доказування є одним із ключових інститутів цивільного судочинства, від якого безпосередньо залежить можливість ухвалення судового рішення на користь однієї зі сторін та ефективна реалізація принципу змагальності. Цивільне процесуальне законодавство України закріплює обов'язок сторін доводити обставини справи шляхом подання належних, допустимих, достовірних і достатніх доказів. Особливого значення в цьому контексті набуває стандарт доказування як відносно нова для вітчизняної цивільної процесуальної науки категорія. Актуальність дослідження зумовлена активним формуванням судової практики у справах про відшкодування шкоди, завданої збройною агресією російської федерації проти України, які набули ознак окремої категорії цивільних справ. Метою статті є визначення особливостей доказування у зазначеній категорії спорів з урахуванням їх предмета доказування та стандарту доказування.
Методи. Методологічну основу дослідження становлять загальнонаукові та спеціально-юридичні методи, зокрема аналіз, синтез, порівняльно-правовий і формально-юридичний методи. Дослідження поєднує теоретичний аналіз доктринальних підходів до стандарту доказування у цивільному процесі та емпіричне вивчення судової практики. Проаналізовано рішення судів першої інстанції у справах, провадження в яких було відкрито після 24 лютого 2022 року, із використанням інструментів Єдиного державного реєстру судових рішень, а також актуальні правові позиції Верховного Суду, сформовані після реформи ЦПК України 2019 року.
Результати. У результаті дослідження встановлено характерні особливості предмета доказування та засобів доказування у справах про відшкодування шкоди, завданої збройною агресією. Виявлено диференційований підхід судів до стандарту доказування залежно від виду шкоди: застосування підвищеного стандарту обґрунтованої переконаності у справах про відшкодування майнової шкоди та стандарту більшої вірогідності – у справах про відшкодування моральної шкоди. Обґрунтовано типовість доказової бази, що переважно складається з письмових та електронних доказів.
Висновки. Аналіз рішень судів першої інстанції та правових позицій Верховного Суду дозволив зробити висновок, що судова практика характеризується єдністю щодо обсягу доказів та їхньої належності для доведення фактів заподіяння шкоди і причинно-наслідкового зв'язку між шкодою та подією, яка її спричинила.
