ЕТИЧНІ РИЗИКИ ТА ПРОФЕСІЙНА ВІДПОВІДАЛЬНІСТЬ ЗА ВИКОРИСТАННЯ ШТУЧНОГО ІНТЕЛЕКТУ В АДВОКАТСЬКІЙ ДІЯЛЬНОСТІ

Вступ. Стрімке поширення систем штучного інтелекту в роботі адвокатів провокує появу питань, які виходять за межі суто технічного застосування: адвокатська діяльність ґрунтується на засадах довіри, конфіденційності та відповідальності, що робить безконтрольне делегування професійних функцій алгоритмам особливо чутливою проблемою. Дослідження спрямоване на виявлення ключових етичних ризиків використання штучного інтелекту в адвокатській діяльності, визначення допустимих меж такого використання, а також обґрунтування необхідності запровадження спеціальних професійних стандартів з урахуванням вітчизняного й зарубіжного досвіду.
Методи. У дослідженні використано формально-юридичний, порівняльно-правовий, системний методи та метод правового моделювання.
Результати. Здійснено аналіз правової природи використання штучного інтелекту в адвокатській діяльності. Визначено основні етичні ризики використання штучного інтелекту: генерування недостовірної інформації, порушення принципів добросовісності та сумлінності, загрози конфіденційності та адвокатській таємниці, репутаційні ризики. Охарактеризовано підходи національної та зарубіжної судової практики до оцінки використання штучного інтелекту, зокрема в контексті відповідальності адвоката за подання недостовірної інформації. Обґрунтовано, що саме по собі використання штучного інтелекту не є порушенням, однак безконтрольне та неперевірене застосування його результатів суперечить принципам адвокатської діяльності. Сформульовано критерії допустимого використання штучного інтелекту в роботі адвоката.
Висновки. Зроблено висновок, що використання штучного інтелекту в адвокатській діяльності є зрозумілою тенденцією розвитку професії адвоката, яка потребує належного нормативного та етичного врегулювання. Встановлено, що ключовою умовою допустимості застосування штучного інтелекту є збереження провідної ролі адвоката у формуванні правової позиції та повної відповідальності за результати наданої правничої допомоги. Обґрунтовано необхідність удосконалення законодавства та правил адвокатської етики шляхом закріплення стандартів використання штучного інтелекту, включаючи вимоги щодо перевірки достовірності інформації, захисту конфіденційних даних та інформування клієнта. Доцільним є також впровадження професійних рекомендацій і навчальних програм для адвокатів щодо безпечного та етичного використання штучного інтелекту.
