СУТНІСТЬ СПОРУ ПРО ПРАВО В ЦИВІЛЬНОМУ СУДОЧИНСТВІ УКРАЇНИ

Вступ. Дослідження присвячено актуальній проблематиці визначення сутності, правової природи, структури та ролі категорії "спір про право" в цивільному процесі України. Аналізується її значення для розмежування видів проваджень (позовного, окремого та наказного). Звертається увага на відсутність єдиного підходу в науковій доктрині, неоднозначність тлумачення в судовій практиці та недосконалість законодавчих норм. Окремо роз-глядаються проблеми, які виникають через невизначеність цієї категорії, а також її вплив на ефективність цивільного судочинства, забезпечення доступу до правосуддя та формування єдності правозастосування. Метою статті є розвиток наукових напрацювань у досліджуваній сфері та сприяння підвищенню рівня правової обізнаності серед фахівців у галузі права.
Методи. У статті використано метод формально-логічний, діалектичний, порівняльно-правовий методи, що дозволило комплексно, цілісно дослідити значення категорії "спір про право" у цивільному судочинстві України.
Результати. Встановлено етимологічні та доктринальні підходи до поняття "спір про право". Визначено структуру спору про право (суб'єкти, об'єкт, предмет, матеріальна та процесуальна складові, умови виникнення та результати). Доведено, що спір про право є детермінантою позовного провадження та критерієм відмежування від непозовних проваджень. Окрему увагу приділено аналізу судової практики, зокрема і Європейського суду з прав людини, результатом чого стало виявлення проблеми встановлення наявності спору про право в межах окремого провадження.
Висновки. На даний момент існують проблеми пов'язані з відсутністю єдиного визначення поняття "спір про право" та його структури, а також з неоднозначним застосуванням у судовій практиці. Для вдосконалення участі цієї категорії в цивільному процесі України запропоновано власне визначення та структуру, а також розпочати розробку чітких критеріїв наявності або відсутності спору про право.
